Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

Had never read the tale this thoroughly.
I stumbled on it when researching the Oregon DOJ
    http://www.doj.state.or.us/career/pages/index.aspx

The AG apparently got her rocket up in 1989 from Goldschmidt, and she is the wife of WW owner Meeker who iirc his Rabbi asked him not to publish Goldschmidt story, so imo the AG has Temple connections with one or more judges or lawyers also worshipping in Portland. Moreover she was a Multnomah Cty bencher.

BS, mbs, that OR DOJ can’t take over the case. Need to be invited by a local gov’t entity, say Mult Cty Commissioners? 300 attorneys; 80 law student interns.

I’m guessing that James returning to live with his mother, after everything written and said, spoke volumes as to whom he would rather live with.

    snip>

    14. Why was James sent to Roseberg? Kaine- “Well he spends summers with his Dad.” He was here for a week and then with the media frenzy and everything going on, it was just decided it was best to get him out of that environment.”
How was your relationship with James? Kaine- “I think it was good.”

B: Waa? He just completely sidestepped (generous term) I mean, omitted the entire fact that James went to live with the Moulton’s, TMH legally CHANGED HIS NAME, changed schools months earlier. There is no way he did not understand the question. It was not until the follow up where the reporter states that some friends of TMH provided info about problems in the home does Kaine address this in direct response. “Um, two boys and a teenage father…”

Desiree chimes in.. “Honestly I think Kaine had a more structured parenting style as opposed to Terri.. I think sometimes when there are different parenting styles it can give you trouble in that area.”

Kaine: And I dont want to get to off track, but I think James would say the same thing. He had told me in the past if anything really bad would happen he would want to come live with me..”

    B

If I had asked that question of kaine and received that response, I would have asked him with that in mind, what was his opinion about why James did not request to return to live with him, or why he has not seen his sister.

I’ve said it before and I’ll say it again.

I do not trust KH, not a bit. There is a reason that LE and KH and DY do not seem to want anyone to consider that TH did not do something to Kyron. If we can figure out that reason, it’s possible that Kyron could be located. Reasons always have people attached to them.

  6. T. Ruth says:

Another thing Mr. Horman states about Mrs. Horman in one interview is that he really has no idea what she does during the day because he is at work. Then later on, he goes on to say where Terri can be found during the day, gym at such and such time, etc., and of course he says, I’m the main caregiver and I work from home more days than not. WTH? Mr. Horman, you cannot have it both ways.

  7. erose says:

“The final relationship that cannot be ignored is with disrupters:

They are individuals who cause trouble for sport – inciting opposition
to management for a variety of reasons, most of them petty.

Usually these people have good performance – that’s their cover – and so they are endured or appeased.

A company that manages people well takes disrupters head-on.

First they give them very tough evaluations, naming their bad behavior and demanding it change.

Usually it won’t. Disrupters are a personality type.
If that’s the case, get them out of the way of people trying to do their jobs.

    They’re poison.

While I am it let me say this- It completely pisses me off that this amount of adults who are believed to at least be reasonable cannot see that none of this convulsion will produce a stitch of information that will ultimately lead to Kyron’s recovery.

I am seriously pretty close to taking the position that there are persons in this case that do not want a conclusion here.

I work for Kyron Horman. This cluster is not leaving anyone to advocate for this boy first. It pains me to say this, but his parents have had to come to the conclusion that nobody knows where he is, and they are no closer under the current investigation and if they continue to sit on their ass and hold nobody responsible I find such motivations for doing so beyond suspect.

What’s another 6 months, 9 months? Has anyone come clean from LE what that would even mean for Ky if he were alive statistically speaking?

I want to know why these 2 are not acting like parents that have no effing clue where their son is, who has him, or if he was killed within hours of his disappearance via a stranger abduction WHICH THEY KNOW AND WERE TOLD was possible.

If TMH had nothing whatsoever to do with Kyron’s disappearance, she had, imo only, the moral obligation as a mother, stepmother, and fellow human being, to do all she could to convince DY to stop wasting precious time, emotions and energies looking at her. Yes, even after DY went public on her feelings and thoughts.

Instead, she remained silent for over 2 1/2 years.

How’s that working out from a moral perspective?
How’s that working out in terms of her daughter and clearing up a “wrong path” to Kyron?
    —————-
I don’t think there is anything TH could say to DY (true or not) that would in anyway convince DY that TH was not behind Kyrons disappearance. Anything TH did or said about KY that was not what DY wants to hear ( which is that TH is guilty and has made Kyron disappear) would immediately become fodder for the media in a press release done by DY and her attorney. TH was questioned by LE multiple time before she got a lawyer it’s obvious LE/DY do not believe her version of events. If it turns out TH is telling the truth about what happened on June 4 what else would anyone expect her to say. If I were TH I would remain silent also. JMO

AG got there the same way the judges of Mult Cty,
including herself, mostly have: interim Gov’s apptmt prior to the election.
Someone resigns or retires early to make way.

Courts reporter “pit bull” Pitkin fired Aug ’11by husband’s paper.
Then AG announces he’s not running again in Oct ’11 & resigns after Ellen announces
her run. He leaves AG’s office early to become Pres of Reed, where her Dad was once Pres.
Kitzhaber appoints her to take his place. A highly qualified Dem runs against her, but she
promotes legalizing med mj (duh). No Republican is stupid enough to oppose her; she had settled in.

Gov Kitzhaber btw was residing then in Portland. His son was attending a

  20. Rose says:

same school or Skyline? I imagine the Gov got very nervous when a boy
disappeared from a school in the same neighborhood. I didn’t realize he’s

Now he’s someone with stones whom the AG completely owes

    1. I do not trust KH, not a bit. There is a reason that LE and KH and DY do not seem to want anyone to consider that TH did not do something to Kyron. If we can figure out that reason, it’s possible that Kyron could be located. Reasons always have people attached to them.

I have been thinking about that too and I’ve come up with a possible reason. What if all of then: Kaine, Desiree, Law Enforcement, all know of very unpleasant and even illegal activities in which they have all been involved. We know there has been huge problems with steroid sales in police depts around state, something like that but bigger and more illegal. If a perp were found and charged, all these things would be revealed at trial, leading to big trouble for LE, DA, Kaine, Desiree and probably others. So they decided to accuse the one person that they knew DID NOT do anything to Kyron, meaning endless investigation on overtime, endless tv appearances, endless stays to divorce, endless fundraising events could be safely conducted without the slightest chance that the case will be solved.

It’s true that people call me cynical.

Whatever happened to Kyron may or may not relate to Kyron’s disappearance. If it is related, maybe some kind of pro is involved to “send a message” or payback for a mistake or something. Or maybe it was just a regular pervert who grabbed a child that happened to have protective coating.

I do not believe there is a vast conspiracy here. I am very proud of the critical thinking skills here, but I do believe there is a such thing as over-analyzing. This is occam. Ky was either lured to his abduction by a stranger with the likely motivation of pedophilia-based deviance or his disappearance is related to the activity, directly or indirectly of someone associated with a principal in this case.

The seemingly cavalier way LE handled RS has me believing it is sadly and unfortunately door no.1 until it can be excluded.

Why would LE behave as though this was an abduction for ransom in the very beginning? That is key.

No electronic footprint, but has masterful IT skills

Has had access to Skyline prior to 6/4/10 possibly through work, which I would guess is construction/electric/plumbing related.

Before you ask, yes, I believe Kyron ran into him in the “Cool Electric” Science Fair displays.

I have no idea how he might be connected to TH or RS, and neither does MCSO or they would have a suspect.

If he is profiling low risk kids (in his opinion) it would be his MO to have been around his victims and have a level of understanding of their family dynamic. In other words, he has assessed in advance

Imo, that is the missing link. I believe they have a physical description of him, thus the facial recognition portion of the cameras and the statement it was an isolated incident. That is the only way that statement does not sound irresponsible to me.

He will set off some people’s “satellites”, but with no obvious justification.

Blink: …or his disappearance is related to the activity, directly or indirectly of someone associated with a principal in this case.

Me: This is the gray area I cannot see. This is what provokes the conspiracy theories because, what could that be? Something as simple as TH posting pictures on FB, all the way to the entire government in Oregon having a hand in this, if not the abduction, then a cover up. Imagination runs away, because how could their actions of any kind promote someone to abduct a child?

Blink: The seemingly cavalier way LE handled RS has me believing it is sadly and unfortunately door no.1 until it can be excluded.

Me: RS and the DEA is suggesting that somehow this landscaper and Horman(s) were involved in illegal drugs. Have LE/DA offered RS immunity for testimony and now there is no recourse? That is all I can think of that would stall their pursuit of information he might have

Blink: Why would LE behave as though this was an abduction for ransom in the very beginning? That is key.

Me: Did the evidence or a witness lead them to believe this? Was this a staged ransom, or did LE misread the case as a ransom from the onset? Is this why the bios kept thinking “stashed” or did LE take their cues from KH, that this was some type of retribution or ransom.

Thanks for putting up with my inane circular questions.

  35. PatriciaMochalatte says:

What if the person who took Kyron “wanted” it to appear that it was a ransom type of abduction? (This way it would take all eyes off of the real person or person(s) who took Kyron.)

It’s interesting to note the CSI T-Shirt Kyron was seen wearing in a picture.
Who are the adult CSI fan or fans in the family?

    Blink,
As I recall you have said Kyron’s abduction is sexually motivated.
It sticks with me. Like attracts like or similar correct?
I keep thinking about how masculine TMH appears in her muscle pics.
Was your snark a hint? I think so. Hormones are a tricky thing. Especially for body builders, apparently.

Where were the kiddos when TMH went to the gym, I wonder?
    Were they always with TMH?
How can this be if KH was the primary caregiver?
    …at least sometimes?
    A few things that I’ve considered…
What in the world could cause Kyron to suddenly have incidences where it made TMH seem to think he was having seizures or some other medical crisis? Kyron apparently had behavioral issues where he wasn’t listening to adults. Was this a sudden thing or is it something that was problematic his whole little life up to this point?
He disappeared pre the alleged Dr. Appt, pre his visit with his bio Mom. (I’m thinking out loud here.)

I would love to have been a fly on the wall near DY when she spoke in private about Kyron being “stashed” somewhere, if she did.

We haven’t heard much if anything from DY’s family members for quite some time either. It all seems so strange. Her Brother was speaking quite a bit in the beginning wasn’t he? Now, nothing. What gives?

I’d never seen this interview with this gentlemen before Dr. Ron Turco. It is interesting, in that he discusses when and why LE will not disclose information:

    http://www.kgw.com/thesquare/Criminal-profiler-Dr-Ron-Turco-analyzes-Kyron-case-95922444.html

#1. “don’t want the perp to be able to react to what you know” IOW, “keep them in the dark”

#2. “you don’t want modifications to their behavior”

#3. “IF they are apprehended, you want secret informatin that you know, that he/she knows, but you haven’t disclosed that you know”.

He also goes on to say “of course” it could be a sex offender in this case. Now, remember this was only June 8, but what’s interesting is that a media outlet, only on June 8, knew something was weird about LE not answering the basic questions that are usually asked in a missing child’s case and so they interviewed him.

Okay, so here’s my question, LE still says to this day “that information didn’t come from us” in regard to the sting and MFH. Release of said informatino, caused an extreme modification in the behavior of Terri Horman. Why would they do that if that was not their goal?

My guess is, it’s another person’s goal to cause that modification in Terri’s behavior, not LE. I’m just not sure whose.

LE protects Kaine at all costs, giving him sensitive information, also leaking cell phone ping, RO contents, sexting and emails to Kaine & Desiree and the press, search Sauvies Island at length. Why?
LE allows/encourages Kaine to become official spokesman for LE, tacitly agreeing to all he says
LE stays civil suit and divorce to prevent Kaine from being deposed.
Kaine and Desiree will not even consider that anybody but Terri disappeared Kyron.
TMH is former teacher, volunteer at school, full time house spouse for family, not history of violence.
Kaine works for international corporation who develops classified projects for gov, attends meetings around the world, travels to California regularly, has many contacts through company. Was not asked to turn over computer. We have no idea if he has history of violence or anything else.

Maybe it is not a “vast conspiracy” but why did they designate TMH as perpetrator and virtually clear Kaine at the beginning of “investigation”? The Hardy Boys could have done a more effective job of solving this.

“Dispelled how wpg? I am not aware of the reason that LE treated this as a ransom outside of speculation on my part, and it is definitely not protocol.”

I saw nothing to indicate LE was treating this as a ransom, only discussions here/speculation on things like “maybe TMH found a note on her windshield”, “maybe Kyron’s glasses were found in the H’s mailbox”, etc. Thought the discussions/replies back and forth eventually led to nothing to substantiate a ransom.

That’s not to exclude, however, that kidnapping would not be on LE’s list, along with other potentials like Kyron wandering away, an accident, a SO abduction, a family/domestic situation, etc.

Remind me, what is that you saw, Blink, that indicated LE was treating this as a ransom from the start.

They wired the house and vehicles and had a deputy stationed at the home 20 hours per day. No amber alert and the 4 parent press conference and it’s structure as developed by LE. I could not say that they did not use that as an excuse to be on top of these people for elimination purposes.

Thinking about kidnapping and ransom again in response to some recent comments here. It occurs to me that whether Intel would actually pay a ransom, through insurance or otherwise, is not as important as whether someone thought they would. I am not inclined to think getting money from Intel was the motive for Kyron’s disappearance, but here’s part of a discussion from last June.

Does anyone know if Intel offers an employee access to a “kidnap insurance policy”?
    —————————–
(MBS) I asked around about this early last year sometime, T.Ruth, but never got an answer from anyone. I thought perhaps it might have been available (even free to those who traveled) and something the company provided when the Horman’s went to Israel and maybe something that was still active for him (like a long term policy that was forgotten). On the other hand, it would probably be for employees working overseas for a period of time. If someone knew Intel carried such insurance for employees in certain circumstances, maybe they would assume they would be more likely to actually pay a ransom. I gather it is designed as a company policy, sort of like group insurance, for certain employees. Don’t know if it’s available to individuals like regular travel insurance. I doubt if Kaine would have seen himself as needing that for the level of employee he was, but you never know.

If anyone wants to read about kidnapping insurance, here are some links. I found it very interesting. Struck me how it was more about the business and financial side than the “we care about our people” perspective, but I guess that’s to be accepted.

1999 – mentions Intel specifically. Older article, but it’s doubtful they do any LESS than they did in 1999 since the world hasn’t gotten any safer. Speaks about employees working outside US – including Israel.

    T. Ruth,
Another person or another arm of the law? Like say perhaps, DEA or? If so, what, and/or who initially prompted that investigation?
TMH pointed the finger at the landscaper/gardener guy. Why? Do we know the connection to Anselmo character? What were the charges against him? D.A.D. was apparently acting strangely/paranoid or whatever. What is the underlying cause of his behaviour?
How bad is illegal steroid trafficking and use in that area?
I’ve read quite a bit about usage among LE. It isn’t a good sign that’s for sure.
Was that sting a parallel investigation that is related by matter of convenience and/or coincidence or is it directly related, somehow?
It’s like looking at a swirling pot of bubbling swill.

Didn’t another landscaper come forward claiming that TMH propositioned a mfh with him also?
    And for that matter,

Am I imagining this or did I read somewhere that DY’s brother does some type of landscaping work also?

Somehow this all fits together. Somehow.
Arresting TMH in a sting operation didn’t pan out. Information gathered defies the notion that TMH took Kyron from school that day. KH’s statements conflict and are therefor not credible. The list goes on.
My heart skipped a beat when I read that DY thought Kyron was no longer alive. I’m not sure where I read it so I don’t have a link.

Oh and isn’t DY’s other ex husband in prison?

And, wouldn’t the amount of time KH gave for when Kyron might be found place Kyron at an age where Kyron could decide who with/where he wants to live?

    I ponder.

  43. erose says:

@Rose, Read back per your suggestion. Early thoughts were that the parents and LE might know who took Kyron. Best bets were that it was someone that worked for the school. How does this line up with KH’s & DY’s thinking that it was TH. In our current dialogue the stand out comment for me was this one, am posting in full, but referencing the 2nd paragraph of Blink’s comment how KH addressed the community:

I believe it was bio mom, step mom, bio dad and step dad who were on video today (Fri) pleading for return of Kyron (refuting theories of estrangement of bio or step mom).

That is correct. I did not see the estrangement some are referencing. Imo, if there were any creedence to the stepmom suspicion, no way would they all have appeared together, and it would be detected immediately in observation.

That said, something is sticking with me since then I cannot shake. I found it odd that Tony Young, step dad, addressed Kyron directly, and Dad Kaine addressed the community.

There was alot of grief in that hug, imo.

I think for me it breeds the possibility that there may have been some sort of vendetta or dislike to Kaine or Terri because they also did not go the standard personalization of the victim by the loving parents, which is standard transference tactic when the profile of a perp, imo, is known to them.

Did they notice someone paying too much attention to Kyron and did they address the issue at the school privately and this individual “showed them”?

If we agree it is likely this offender is known to them, can we assume this day was picked specifically? I think the 911 call would tell us the answer to that.

Why did KH address the community?

  44. erose says:

I have to be honest about where I think my processing problem is. When we look at KH’s behaviors, I start to suspect him. Somehow I jump to that extreme because I cannot find that sweet spot in my mind that allows me to see this guy in color instead of black and white.

What could he do, have done, been involved, whatever-who-cares-how-bad-it-is-just-spill-it stuff, that would contribute to the abduction of his son and why wouldn’t he come clean about it in order to find his son? I.just.don’t.get.it. What is further odd about my thinking is that I have been able to get perspective on TH over that past almost 3 years. Just when I think my mind is about to expand, I get a contraction. :/

    I know.

The problem i have is that his demeanor and subsequent filings post Jun 26th went from zero to 3000 degrees with blue flames in seconds.

Man scorned he thinks, as told to him by LE. Child taken, as told by LE. That stuff I believe initially was to keep her away from joint funds the second she said she wanted to hire an atty.

Enter pic of sealed order that Cook comes up with ( yes, I resisted the urge to say cooks up).

Does a guy like that set her up royally in such a serious matter to the extent it could harm ever finding Ky as he states he really believes she is involved? Am I taking that chance as a parent? No effing way. I want her close, I want her talking, I want her texting.

Remember- six figure legal bill he said.

Well at least I can get a good hunch once and awhile.

    snip>

Oregon Attorney General candidate Ellen Rosenblum has bagged Oregon’s richest man as a campaign contributor.

The contribution, Rosenblum’s largest, will help close the funding gap that has developed between Rosenblum and opponent Dwight Holton. But it won’t eliminate Holton’s advantage.

As of Tuesday, Holton had raised $437,249 to Rosenblum’s pre-Phil Knight total of $350,399.

A possible connection between Knight and Rosenblum could be Dave Frohnmayer. The Eugene lawyer and former University of Oregon president is a staunch backer of Rosenblum’s and is also close to Knight.

  46. erose says:

Frohnmayer was the Republican nominee for Governor of Oregon in 1990. Popular Democratic incumbent–and former UC Berkeley School of Law classmate–Neil Goldschmidt withdrew after Frohnmayer’s campaign manager, Donna Zajonc, said “…you’ve got to believe that the best family will win” at a news conference,[1] which was then reported by Jeff Mapes in The Oregonian.[2] Zajonc’s statement was interpreted at the time as a threat to use Goldschmidt’s collapsing marriage as a political issue.[2][3] Goldschmidt quickly withdrew from the race, an event that was considered one of the “great mysteries in Oregon politics”[1] until 2004, when Goldschmidt admitted to having a sexual relationship with a minor in the 1970s.[4] Frohnmayer subsequently lost the election to Barbara Roberts, the Democrat who was nominated after Goldschmidt’s withdrawal, in a three-way race that included independent, Oregon Citizens Alliance-backed[5] candidate Al Mobley.
